## 1. Acceptance of These Terms
By using the Service, replying to messages from the Service, providing your phone number to be added to the family group, or continuing to receive messages after being notified of these Terms, you agree to be bound by these Terms of Service.
If you do not agree to these Terms, do not use the Service and reply **STOP** to any message or contact the Administrator to be removed.
These Terms constitute a binding agreement between you and Justin White (the "Administrator") regarding your use of the Service. They are in addition to any separate consent you may have given for receiving SMS messages.

## 2. Description of the Service
The Service is a **personal, private tool** that uses Twilio’s infrastructure to send and receive SMS text messages exclusively among Justin White and his immediate family members (spouse, children, and any other individuals explicitly designated by the Administrator as "immediate family").
Key points:
- This is **not** a commercial product, public app, or service available to anyone outside the designated family group.
- The primary purpose is convenient, private family communication (coordination, updates, quick check-ins, sharing important information, etc.).
- The Service may include a simple web or app interface for the Administrator to manage contacts and send messages (if implemented). Any such interface is also covered by these Terms.
- The Service is provided free of charge for personal family use.

## 3. Eligibility and Family-Only Use
- The Service is available **only** to Justin White’s immediate family members as designated by the Administrator.
- You must be an immediate family member or have been explicitly added by the Administrator.
- You may not share access credentials (if any), forward messages outside the family group without permission, or add non-family members.
- The Administrator reserves the right to add or remove any phone number at any time, with or without notice, to maintain the private family nature of the Service.

## 4. Your Consent to Receive SMS Messages
By being added to the Service or replying to any message, you provide your prior express consent to receive SMS text messages from the Service to the phone number you provided or from which you replied.
You may withdraw this consent at any time by:
- Replying **STOP**, **UNSUBSCRIBE**, **QUIT**, or similar keyword to any message, or
- Contacting the Administrator directly.
We will honor opt-out requests promptly. Note that standard carrier message and data rates may apply to SMS messages you send or receive.

## 5. Acceptable Use
You agree to use the Service only for lawful, personal, family-related communication. You must not:
- Send spam, unsolicited commercial messages, or bulk messages
- Send content that is illegal, threatening, harassing, abusive, defamatory, obscene, or hateful
- Impersonate any person or entity or misrepresent your identity or relationship to the family
- Use the Service for any commercial, business, promotional, or political purpose (even if related to family events — discuss with the Administrator first if borderline)
- Attempt to reverse-engineer, hack, disrupt, or interfere with the Service or Twilio’s systems
- Violate any applicable law, including the Telephone Consumer Protection Act (TCPA) or Twilio’s Acceptable Use Policy
The Administrator may immediately remove anyone who violates these rules and may report serious violations to authorities if required.

## 6. Content and Responsibility
- You are solely responsible for the content of any messages you send through the Service.
- Message content is shared only with other immediate family members who are part of the Service. It is intended to remain private within the family.
- Do not send highly sensitive information (e.g., Social Security numbers, full financial account details, medical records, or passwords) via SMS unless you accept the inherent risks of standard SMS (which is not end-to-end encrypted).
- The Administrator is not responsible for the accuracy, completeness, or consequences of any information shared in messages.

## 7. No Warranty; Service Provided "As Is"
The Service is provided **"AS IS"** and **"AS AVAILABLE"** without any warranties of any kind, whether express or implied.
We do not guarantee that:
- Messages will be delivered on time or at all (SMS delivery depends on carriers, device status, network conditions, etc.)
- The Service will be uninterrupted, secure, or error-free
- Any web interface will always be available or function perfectly
- Message history will be complete or permanently retained
You use the Service at your own risk. The Administrator makes no representations about the reliability of SMS for time-sensitive or critical communications (e.g., medical emergencies — always use voice calls for true emergencies).

## 8. Limitation of Liability
To the maximum extent permitted by applicable law, the Administrator (Justin White) shall **not** be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of (or inability to use) the Service.
This includes, but is not limited to:
- Missed or delayed messages and any resulting consequences
- Loss of data or message history
- Any issues caused by Twilio, mobile carriers, or third-party infrastructure
- Any personal disputes or misunderstandings arising from message content
Because this is a **free personal family service** with no fees charged, the Administrator’s total liability to you for any claim is limited to **$0** (or the minimum amount required by law, if any).
Nothing in these Terms limits liability for gross negligence, willful misconduct, or fraud.

## 9. Intellectual Property
- Any custom code, scripts, web interface, designs, or documentation created for the Service are the exclusive property of the Administrator (Justin White), unless otherwise agreed in writing.
- You may not copy, modify, distribute, or create derivative works from the Service or its components without permission.
- Message content you create remains yours, but by sending it through the Service you grant the Administrator and other family members the right to view, store (temporarily), and reply to it within the family context.

- **By Administrator**: The Administrator may suspend or terminate the Service (or your access to it) at any time, for any reason, including but not limited to suspected violation of these Terms, technical issues, or changes in family circumstances. We will notify affected family members when reasonably possible.
- Upon termination, message history may be deleted according to the Privacy Policy timelines.

## 12. Changes to These Terms
The Administrator may update these Terms from time to time. Material changes will be communicated to family members via a message through the Service or other family channels.
Your continued use of the Service after changes are posted or communicated constitutes your acceptance of the updated Terms.

## 13. Governing Law and Dispute Resolution
These Terms are governed by the laws of the **State of Georgia, United States**, without regard to its conflict of laws principles.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved informally and amicably among family members. If that is not successful, disputes may be brought in the state or federal courts located in **Paulding County or Cobb County, Georgia**.
